Senate Bill May have Impact on Survivors of Mesothelioma Victims

The Missouri Senate that has passed a bill to fund the bankrupt Second Injury Fund of the Missouri Workmen’s Compensation System.  This bill also has some provisions though that relate to liability claims that have been in the courts for several years.

In an effort to keep the Second Injury Fund solvent many toxic exposure cases were removed from the Workers’ Compensation Second Injury system. These changes have caused the number of lawsuits on general liability policies to increase dramatically.

A special category has been placed back into the second injury fund for these types of toxic exposure cases. The new bill tries to make settlements which will answer the claims of those who have lost a loved one due to these kinds of exposures.

There have been many claims over the years related to substances like asbestos, which causes mesothelioma.  The Second Injury Fund insolvency has caused some of these cases to get almost completely ignored.

Anyone who has lost a loved one due to a work related injury or illness should contact the St. Louis law firm of Hoffman & Gelfman to discuss their situation.
